Boomerang Terms and Conditions for Empty Leg Bookings
Definitions
Parties - The parties who are entering into this agreement are "Charterer" and/or "Charter Broker" and "Charter Company."
Charterer - The individual or entity requesting the charter service.
Charter Broker - The entity requesting the charter service and representing the end user (Client/Customer/Charterer).
Charter Company - The company providing the service known as "YOUR CHARTER COMPANY"
EMPTY LEG – A portion of a trip that does not contain any passengers as originally booked. An Empty Leg is attached to another trip that is already booked and scheduled to fly.
PARENT TRIP – A trip that is already booked or about to be booked that contains an empty leg that is for sale.
General
You are booking a one-way EMPTY LEG and understand that this empty leg is attached to another trip that is already booked or about to be booked. You also understand that in the event that the original PARENT TRIP should cancel, in which this empty leg is attached to, this empty leg will also cancel. In the event that your empty leg is canceled due to the parent trip canceling, you will receive a full refund.
Pets
No pets are allowed on a one-way EMPTY LEG flight.
Cancellation
Empty Leg bookings are final and not refundable except if Boomerang cancels your flight due to weather or due to the original “parent” trip canceling, in this case, you will receive a full refund. Empty-Legs are an affordable way to travel on the reposition leg of another trip. However, keep in mind that if the parent trip cancels, your empty-leg will also cancel and you will receive a full refund for your purchased Empty-Leg.
This quote is based upon aircraft and crew availability. Landing, Ramp, Handling and other FBO fees contained in quote pricing are based upon Charter Company's preferred FBOs. Requested use of non-preferred FBOs may result in additional charges and/or fees. This quote does not include additional requested catering, de-icing fees, hangar fees or deviations to this itinerary.
Payments and Cancellation
Full payment is due at checkout when reserving your empty leg purchase. One-way Empty Legs are not refundable except for the condition listed above.
Documentation
Government Issued Photo ID's are required prior to flight. Additionally, official travel documents (passports, visas, etc,) are the responsibility of each passenger. At the discretion of the pilot in command, passengers without proper documentation will be denied boarding. Neither the Charter Company nor Charter Broker will have any responsibility or obligation to such passenger/s and there will be no refund of charter cost. Domestic flights require a manifest minimum 24 hours prior to flight. International flights require a manifest 4 days prior to flight. Changes are permitted to manifest within a reasonable time prior to the flight date.
Itinerary Changes and Transmittal Of Changes
Itinerary/routing changes are permitted, but subject to aircraft and crew availability and subject to price adjustment. Notification of all changes and/or cancellations must be in writing and sent via email to info@flyboomerang.com within the cancellation timeframe listed above.
Responsibility
Charter company shall not be liable for any injury, damage, loss, expense, indirect, special, or consequential damages, or other irregularity caused by the defect of any vehicle or conveyance, or the negligence of any company or person engaged in conveying the passenger or carrying out the arrangements for your trip or by accident, delay, flight schedule, change, cancellation, sickness, weather, strikes, war, quarantine, or any similar cause. Our liability shall in any case be limited to the amount paid to us. Charterer is responsible and liable for any passenger damage to aircraft. Any and all claims shall be adjudicated in and governed by the laws of state(s) in which we have our principal business location.
Partial Completion of Flights
Charter company is not liable for expenses incurred for replacement transportation in the case of mechanicals, in such cases our charges apply only on portions of flight completed. If a flight does not reach its destination due to weather, charges apply to any destination reached and return flight of the aircraft and crew (with or without passengers) to home base. In the case of mechanicals, Charter Company may at its option provide substitute transportations which shall be charged as an additional fee to the charterer. In such cases, Charter Company’s original charges apply only on portions of the flight completed.
Operational Control
Aircraft owned or leased by Boomerang, LLC are operated under FAA Part 135 regulations. Charterer and/or Charter Broker shall hold harmless and shall indemnify Boomerang, LLC against any and all losses. All flights will be operated by FAR Part 135 air carriers that meet all FAA safety conditions listed herein. This document becomes a legal and binding contract between all parties.
